Madison comes to agreement with J&J Earthworks over liquid damages
The city of Madison has come to an agreement with J & J Earthworks on a final dollar amount the city will assess in liquid damages for the water system improvement projects Phases 1A and 1B. J & J Earthworks was the contractor on the two water system improvement projects funded through Rural Development. Construction started in 2021 and continued until final completion for both projects on May 16 of this year. That was significantly later than the contract deadline.Â
During their August 5th meeting, the city commission discussed assessing liquid damages to J & J that would have totaled over 344-thousand dollars, as well as additional costs of over 100-thousand dollars.Â
After negotiations with the contractor, the city is recommending that commissioners assess J & J Earthworks $125,816.66 in liquidated damages. City employees believe this amount will adequately cover additional expenses incurred by the city, and allow city workers to complete additional re-seeding that is needed.Â
Other items on the City Commission agenda for today’s meeting include accepting a transfer of land near the Waste Water Treatment plant from the LAIC, and approving a proposal from Canfield Business Interiors for City Hall furniture.Â
