A Lake County man has avoided prison time, after pleading guilty to assaulting a law enforcement officer. 21 year old Brendan Matheny (Math-in-E) had previously pleaded guilty to one count of simple assault on a law enforcement officer, and for intentionally causing contact with bodily fluids. 

 

On Dec 18th of 2022 officers were called for a welfare check at Matheny’s residence. He was found to be intoxicated on drugs and alcohol. Matheny charged at officers and kicked and caused injury to at least one officer, and spit in officers face.

 

On Tuesday, Circuit Court Judge Patrick Pardy sentenced Matheny to 2 years in prison, but suspended that time based on certain conditions that include Matheny paying all fines, costs, and restitution, and being on supervised probation for 3 years. Judge Pardy said Matheny’s lack of criminal history was a significant factor in this decision to suspend the prison time. 

 

The Judge also sentenced Mantheny to serve 73 days in jail on the misdemeanor charge of  intentionally causing contact with bodily fluids. He was given credit for 43 days served.
